
Diageo launched the action two years ago claiming that ICB was passing off Vodkat, a 22% abv speciality spirit, as vodka. Vodkat's abv is significantly lower than the EU's definition of vodka which states that it must be at least 37% abv.
Mr Justice Arnold ruled that any product using a brand name derived from vodka which was not vodka was likely to confuse the public.
ICB said it would examine the court injunction to determine the changes it would need to make to the product but vowed that the ruling would not prevent its sale.
Last year Diageo began legal proceedings against Sainsbury's over the supermarket's Pitcher's brand which it claimed was too similar to its summertime drink Pimms. It later dropped its legal battle after Sainsbury's agreed to make some changes to its packaging.
