Five viewers complained to Ofcom about the video by The Streets, aka Mike Skinner, for 'Blinded by the Light' after it was broadcast on The Box and Q before the 9pm watershed on three occasions and one time at 11pm. Another viewer believed the content was unsuitable for broadcast at any time.
Emap blamed its scheduling system, saying it was programmed to play well after the 9pm watershed but due to a software error it played much closer to the watershed than intended.
Since the incidents in October, Emap has moved the video from all playlists and moved its own watershed from 9pm to 10pm to prevent similar problems.
Because of the strength of the video and the repeated broadcasts before 9pm, Ofcom found Emap in breach of the Programme Code.
'Blinded by the Light' was the follow-up single to previous hit 'Dry Your Eyes' taken from the album 'A Grand Don't Come for Free'.
