OFT to look at VMtv sale

The Office of Fair Trading is to investigate if the sale of Virgin Media Television to rival broadcaster BSkyB requires further regulatory action under the Enterprise Act 2002, and has asked interested parties to comment.

In a statement today, the OFT said it is considering whether arrangements are "in progress or in contemplation which, if carried into effect, will result in the creation of a relevant merger situation under the merger provisions of the Enterprise Act 2002".

If the sale is found to be a relevant merger situation, the OFT could refer the sale to the Competition Commission if it feels it could result in a substantial lessening of competition within any market or markets in the UK.

(13 July) and renamed the company the Living TV Group after completing the regulatory process in the Republic of Ireland.

The sale did not require pre-approval from the UK authorities but both businesses must be run as completely separate operations until a decision has been made by the OFT and/or the CC.

Parties have until 4 August to send written representations about any competition or public interest issues which the sale may cause and a decision is expected later in the year.
