Ofcom warns Bauer Radio over future conduct

LONDON - Bauer Radio has avoided Ofcom sanctions after a rigged ticket giveaway aired on Kerrang! Radio became the subject of a regulatory investigation.

In April, the Kerrang! Radio's 'The Morning After' breakfast show held a phone-in contest to win tickets to the premiere of the Rolling Stones documentary 'Shine a Light'.

Host Tim Shaw allegedly rigged the contest, using a pre-recorded phone-in entry from a friend, a Rolling Stones fan who suffers from a chronic and debilitating illness.

Shaw admitted to the claims after a complaint was lodged to Ofcom, and later told the regulatory commission that he was "doing the right thing by rewarding a loyal and deserving listener".

In its decision, Ofcom found there had been a breach of trust between the presenter and the audience, which had potential to cause considerable listener harm even though Shaw's actions were "well-intentioned".

It considered referring the case to the Content Sanctions Committee to issue a penalty but ultimately decided to forgo the decision because "consumer harm was limited".

Shaw was later sacked from Kerrang! Radio, and Bauer Radio walked away with a warning that further action would be taken in the event of another breach of conduct.
