In a marked shift from its original stance, the regulator is to set out the costs and benefits of screening such ads after 9pm and is inviting revised responses from organisations and individuals.
The National Heart Forum, which had led the campaign for restrictions, has withdrawn its call for a judicial review to what it saw as Ofcom鈥檚 hardline stance.
鈥淥fcom still maintains that the 9pm option would place a 鈥渄isproportionate鈥 burden on broadcasters, but it has clearly 鈥揳lbeit reluctantly - acknowledged the ground swell of public opinion that this option merits serious debate as part of this consultation,鈥 said Jane Landon, deputy chief executive of the NHF.
It did not however rule out further action if Ofcom maintained its position.
