LONDON - Global Radio has hit back at an Ofcom ruling over the diversity of its play list by claiming the watchdog passed judgement before the deadline for response had passed.

 In a statement the broadcaster called this is an ‘extraordinary way for a regulator to behave' and said it does ‘not accept this finding' and is ‘considering its position'.

Ofcom issued a Yellow Card to Global Radio's Bristol station today ruling that although it is branded as a contemporary and chart music information station, GWR Bristol's output contained less than fifty per cent of music released within the last two years.

Ofcom said: "If we find that these issues have been addressed when we monitor the station again, after 23 March, then the Yellow Card will be lifted. If GWR does not come back within Format within the week we will move to sanctions, which could involve a fine or shortening of licence."

Global Radio is about to rebrand the Bristol station as Heart radio. It said Ofcom's decision was made without reference to either the station, or by talking to the Global Radio group.
