DMA raises fears over electoral roll case ruling

The DMA has warned that a court ruling on the use of the electoral

roll sets a worrying precedent.



Brian Robertson won his case last month against Wakefield City

Council.



He claimed the council breached his rights under the Data Protection Act

(DPA) and the Human Rights Act 1998 by refusing to say his details would

not be given to third parties without his consent.



The DMA believes the court's decision fails to take into account the

safeguards provided by the DPA and MPS.



Caroline Kimber, director of direct marketing and financial services

divisions at CACI, said the case was a "non-issue" because impending

legislation will place an opt-out option on the electoral roll as of

2002.
